By agreeing to these terms, you agree that you understand my terms of commissioning or purchasing a product or service from me as a freelance artist and psychic medium, and what I require in terms of payment and the terms of personal use vs. commercial use. This document will only be relevant as long as I am an individual freelancer and/or sole proprietor, and may change if I am contracted to work with a company or other kind of group.My ToS may be subject to change at any time for the betterment of buyer and seller protection. Changes will only affect clients who order from my sole proprietorship after the date that the changes are implemented.

Completion Estimates: I Can NOT give an exact estimate as multiple factors contribute. Each art piece varies. My schedule with work and home varies. Ground shipping varies and I have no control over. But most of all it definitely depends on the waiting list/queue. Feel free to check the progress or where you are on the waiting list. You can also check my project/personal life list to see a glimpse into what I am working on besides client orders.
I focus on first come first serve basis. And work to complete in a timely reasonable manner for my work load.

My prices are subject to change based on my availability to work on commissions and the amount of demand. The prices listed here are guaranteed to be accurate at the time of purchase and will not be altered during the transaction. The agreed payment for the commission at the time of purchase will be the expected payment even if prices are increased on site for future purchases.
The prices I have listed are the minimum for that commission type (not including sales or discounts). Complex characters and complicated requests may increase the price.PAYMENT:
I accept payment on my designated Venmo, PayPal, Etsy, or Ko-fi.
I take payment upfront. I do not work on unpaid commissions anymore. I will only do partial payment plans for commissions over $50 (half up-front/half after sketch is approved).
It is my job to calculate and pay the necessary state taxes for Idaho except for payments made through Etsy. State Taxes are considered included within the prices listed. IF there is another fee that any of these services asks of you or I it is up to the owner of said account it is asking from (typically me as the business owner) to pay said fees. If it is asking you to pay a buyer fee that is NOT my responsibility; if it is asking me to pay a seller fee that is NOT your responsibility.
Do NOT send payment until I have confirmed that I have accepted your order and added your order to the queue.
I will always prioritize USD commissions over non-USD commissions (such as game currency payments or raffle prizes or trades). Please keep this in mind when commissioning with an alternative payment method.REFUNDS:
I do not issue full refunds once I have started your order. I will give at least half refund after finishing the sketch if you are unhappy with it and want to cancel at that point. I am willing to edit or change a sketch, but I will NOT guarantee I will completely redo (brand new) the sketch more than once. If you would like to cancel your order before I have begun working on it, I will refund you and remove you from the queue. Once you approve the sketch and I continue on the piece, refunds will not be given except for serious malpractice on my end.CANCELATION:
I, the artist, reserve the right to cancel a commission for any reason. Any commissions canceled without a given reason or due to my inability to complete them will result in a full refund for the client. The client reserves the right to cancel the commission for any reason at any time, but may not receive a full refund after the sketching phase. If you would like to cancel your order before I have begun working on it, I will refund you and remove you from the queue. For art cancellations, this forfeits ownership of what I do with it from there to my full jurisdiction, including wholesale, YCHs, etc. I will NOT be reselling a artwork of your character (because you have ownership rights to your characters), but the lines or sketch may be reused or repurposed. This repurposing will NOT include deity portraits for ethical reasons and respect to your energy and their connection to you. I do reserve the right to repurpose all other cancelled commissions for consideration of my own time and energy.PROCESS:
I will be checking in with you during the process for your input, I guarantee a check in after the sketch and after the flat coloring phase (as to make sure the characters' colors/marks are correct before shading). Major revisions can only be made during the sketch stage. This includes changes to posing/expressions, body/face shape, or the addition/removal of limbs or clothing. The commission will not move past the sketch stage until the client approves of the sketch as a whole.COMMERCIAL RIGHTS:
I, the artist will retain all legal and artistic rights to the image being commissioned. I can use the commissioned image in my portfolio and galleries as I see fit. I however will NOT sell a custom commission as a print or sticker or other product for widesale use.
While the completed art piece you commissioned does belong to you, you may not profit off of my art in any way, shape, or form. This includes selling prints, stickers, or other merch with my art on it. This applies regardless of your ownership of the character in the image.
The Buyer may NOT:
-Use the image to promote sales/advertise/generate income in ANY way, shape or form. My commissions are for non-commercial, personal use ONLY. (Unless that was agreed upon by me in writing and I am given proper credit and compensation).
- Use the image as a book cover/music cover/website cover/company logo (Unless that was agreed upon by me in writing and I am given proper credit and compensation).
- Sell the artwork as an NFT or any other digital or physical product (this will result in an immediate ban from all my services)
- Edit out my signature or watermark from the original image.
- Trace, make bases out of, or copy the original artwork.
- Claim the image as their own creation, regardless of how much of the image has been edited or how it's been used.
The buyer may:
- Publicly post it online in character galleries such as Toyhou.se and ArtFight, as long as it is with proper credit by linking to my page or social media @AmaraPopsicles
- Use any part of the image as an icon, banner, or avatar for social mediaNFTS:
I do NOT participate in the buying or selling of NFTs and strictly prohibit my art from being bought or sold as NFTs.

The buyer/client is responsible for shipping costs.
I automatically do the cheapest shipping option of ground shipping. This has no guarantee on when it arrives nor is there estimates. I WILL give you your tracking number if they give me one. You can pay more to get a faster shipping option but it must be be equivalent.I am NOT responsible for missing or lost items due to a mail delivery system's error Or for giving me the wrong address. PLEASE double check the address. If it is my error based on the address you sent and the one the shipping receipt has a discrepancy that is MY responsibility and MY error. If it IS my error you will not have to pay again. That is my responsibility to try to get them to return to sender/change address OR if that fails to create a replacement. This replacement because my items are handmade, and unless it is a print is going to have differences. I will be checking in with you during the process for your input. I WILL NOT redo entire processes that would require restarting for example, resin pours. However, things that can be altered easily and reasonably, at my discretion.COMMERCIAL RIGHTS:
I, the artist will retain all legal and artistic rights to the image of what is being commissioned/custom-made. I can use the commissioned/custom-made item in my portfolio and galleries as I see fit.
Handmade items may be similar to one another when commissioning, but this is NEVER with the intention to directly copy another commission/custom. Pieces may have duplicate patterns and colorations. This is just the reality of a physical product, not with the intention to be a disservice to another client.
